  1. General

1.1 By accessing the website at https://specialisedhomeconstructions.com.au/ and any of the pages forming part of that website (Website), you agree to be bound by these terms and conditions. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

1.2 As a condition of accessing, browsing, using or relying on any part of the Website, you must read and accept these terms and conditions of use. By accessing, browsing, using or relying on the Website, you acknowledge you have read, understood and agreed to comply with these terms and conditions of use.

1.3 The Website is operated by JG King Pty Ltd ABN 21 006 627 210 Registered Building Practitioner CDB-U 49366 (VIC) and JG King (NSW) Pty Ltd 385938C (NSW).

1.4 Any offer made is made by Specialised Home Constructions and not BlueScope Steel Limited. To the maximum extent permitted by law, BlueScope Steel Limited is not responsible for the administration of, nor liable for any damage or loss arising from, any offer made.

  1. 7 Star Homes

Specialised Home Constructions can deliver all STANDARD house designs to achieve 7 Star Energy Efficiency on any orientation.

If changes are made from STANDARD house designs Specialised Home Constructions cannot guarantee achievement of 7 Star compliance.

Specialised Home Constructions will deliver windows that are the same size and same location in all their home designs. To achieve 7 Star compliance all windows will be made from European Styled (uPVC) Double Glazing. The glazing will come with a Low E Coating.

Specialised Home Constructions Homes can deliver homes throughout Victoria as depicted in Specialised Home Constructions build zone regions map.

As standard all Specialised Home Constructions will deliver European Styled (uPVC) Double Glazed windows as standard. The glazing will come with a Low E Coating. Specialised Home Constructions do not supply uPVC windows to homes build in the Mildura region.

When Specialised Home Constructions refers to windows and doors it includes all windows, rear sliding doors, and sliding laundry doors. External swing doors and side lights will remain Timber with Timber frames.

All STANDARD Specialised Home Constructions House Designs will achieve 7 Star Energy Efficiency in any orientation. For this purpose STANDARD designs means one of the standard designs on this website, not incorporating any of the available floorplan choices or owner requested modifications.

To achieve 7 Star compliance all windows will be made from European Styled (uPVC) with double glazing. The glazing will come with a Low E Coating.

  1. Amendments

3.1 At any time, Specialised Home Constructions may change, add or remove any part of these terms and conditions of use or any features of the Website.

3.2 Your continued use of the Website after such change, addition or removal constitutes an agreement by you to abide by, and be bound by, these terms and conditions of use, including as regards any changes Specialised Home Constructions may have made.

  1. Intellectual property

4.1 Specialised Home Constructions owns, or is otherwise licensed to use, all intellectual property in the Website. Subject to these terms and conditions of use, Specialised Home Constructions grants you a non-exclusive, revocable and non-transferable licence to view, download and use information directly accessible through the Website for personal and non-commercial use.

4.2 Nothing in these terms or on the Website should be construed as granting any right, title or interest in, to or in relation to any of Specialised Home Constructions’s content, images, trade marks, trade secrets, know-how or other intellectual property rights.

4.3 Any and all of Specialised Home Constructions’s intellectual property rights (including in the Website, its content, data and images) is its sole and exclusive property.

4.4 You agree that, subject to your use of the Website in accordance with the limited licence granted to you by these terms, you will not infringe Specialised Home Constructions intellectual property in the Website and will not:

(a) reproduce, modify, transmit, copy, adapt, sell, publish, frame, distribute or communicate any part of the Website; or

(b) use it in a way which infringes our intellectual property or other property rights.

Specialised Home Constructions does not not warrant that any of this material is accurate, up-to-date, suitable for your purpose(s) or without errors, omissions or viruses, nor does it guarantee continuous, uninterrupted or secure access to the Website.

5.2 You acknowledge that access and use of the Website (including the software operating in connection with the Website) may be interfered with by numerous factors outside of Specialised Home Constructions’s control, including, but not limited to, persons with malicious intent.

5.3 Specialised Home Constructions does not warrant the accuracy of any advice, opinion, statement, representation or other information displayed on or accessible through the.

  1. Use of information

6.1 If you upload, or otherwise provide, any information or content (Content) in the course of accessing or using the Website, you confirm that such Content will be available to Specialised Home Constructions to use in any manner it thinks fit, subject to applicable provisions of any Australian legislation, including, without limitation, privacy legislation.

6.2 You agree to grant Specialised Home Constructions a worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise and use the intellectual property you have in any Content, in all media (whether now known or not yet known). You also agree to waive any moral or similar rights you may have or acquire in the future in that Content in our favour.

7.1 You agree that Specialised Home Constructions is not liable to you or anyone else for any loss or damages (including indirect, special, consequential loss, loss of data, loss of profits, revenue, data, goodwill, opportunity or anticipated savings) arising out of, or in connection with, the use or access of the Website, the use by Specialised Home Constructions of the Content, or any loss or damage which may arise should you be unable to access the Website for whatever reason and however arising and whether caused by breach of statute, breach of contract, negligence or other tort or otherwise.

7.2 You indemnify Specialised Home Constructions from and against any action, liability, claim, loss, damage, proceeding and expense (including legal costs) suffered or incurred by it, arising from, or which is directly or indirectly related to:

(b) any breach or inaccuracy in any of your representations or warranties; and

Specialised Home Constructions has not reviewed all of the websites linked to the Website and makes no representation as to the contents including the accuracy of information contained within any such linked site. The inclusion of any link does not imply endorsement by Specialised Home Constructions of the site. Use of any such linked website is at the user’s own risk.

  1. Breach and termination

9.1 If, in Specialised Home Constructions’s opinion, you breach any provision of these terms and conditions of use, it may immediately temporarily suspend or permanently prevent your access to all or any parts of the Website.

9.2 In any event, Specialised Home Constructions may terminate these terms and conditions of use (and your right to use the Website) at any time and for any reason without prior notice to you.

  1. Severability

If any provision of these terms and conditions of use is found by any court or body of competent jurisdiction to be wholly or partially illegal, invalid, void, voidable, unenforceable or unreasonable, then it shall be severed to the extent of the illegality, invalidity, voidness, voidability, unenforceability or unreasonableness, but the remaining provisions shall be unaffected and continue in full force and effect.

  1. Waiver

Failure or delay by Specialised Home Constructions in enforcing or partially enforcing any provision in these terms and conditions will not be construed as a waiver of any of its rights.

  1. Governing law and jurisdiction

12.1 These terms and conditions, and the agreement of which they form part, is to be governed by the laws and exclusive jurisdiction of the state of Victoria, Australia.

12.2 You submit irrevocably and unconditionally to the jurisdiction of the courts of the state of Victoria, Australia in all disputes related or connected to these terms and conditions of use.

The 50-year structural warranty is provided by BlueScope Steel Limited and is subject to application and eligibility criteria.
